Oracle has issued a force majeure notice covering Project Jupiter, a large Stargate data center campus planned for New Mexico. The contractual step does not withdraw Oracle as the main tenant, but could let it delay payments if the facility fails to begin operating in 2028.
Oracle and developer Blue Owl Capital both say the project remains on schedule and that the notice does not change long-term financial commitments. The precaution follows unresolved dependencies around the campus’s energy supply. Jupiter is designed for 2.45 gigawatts and is expected to rely on gas-powered fuel cells from Bloom Energy.
A pipeline intended to supply that gas has been delayed by nearly six months, until February 2027, after regulators repeatedly rejected permits and the route changed. A separate state air-quality permit for the fuel-cell system is still pending, with a November 23 decision deadline.
The campus is a flagship site in the Oracle, OpenAI and SoftBank Stargate infrastructure initiative. It has also drawn local and environmental opposition. The notice shifts some schedule risk before construction is complete; it does not establish that a delay will occur, and Oracle says it remains fully committed to the site.
